This website is operated by Glittertubes. Throughout the site, the terms “we”, “us” and “our” refer to Glittertubes. Glittertubes offers this website, including all information, tools and products available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, disclaimers and notices stated here.
By visiting our site and/ or purchasing something from us, you and agree to be bound by the following terms and conditions (“Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms and conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website.
Any new features/tools/products which are added to the current store shall also be subject to the Terms of Conditions. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted by Godaddy. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

CONTRACT FORMED REGARDING PURCHASES

1.1 You may place an order to purchase a product advertised for sale on the Site by following the onscreen prompts after clicking on the item you are interested in. You will have an opportunity to check and correct any input errors in your order up until the point at which you submit your order by clicking the “Make Payment” button on the “Order Confirmation” page.  

1.2 After placing an order, you will receive an e-mail from us acknowledging that we have received your order and giving an order number and a summary of your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm our acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (Dispatch Confirmation). The contract between us will only be formed when we send you the Dispatch Confirmation.

1.3 If we are unable to supply you with a Product, we may supply you with an alternative product depending on the availability of the Product purchased. We may also be unable to supply you with a product because that Product is not in stock or is no longer available or if there is a problem with authorisation of the payment card you have provided. If you have already paid for the Product, we will refund you the full amount including any delivery costs charged as soon as possible if all products purchased become unavailable.

BILLING AND ACCOUNT INFORMATION

1.4 We reserve the right to refuse any order with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by via e-mail. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

OUR PRODUCTS

1.5 The images of the Products on the Site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's/mobile's display of the colours accurately reflect the colour of the Products. Your Products may vary slightly from those images.

1.6 The packaging of the Products may vary from that shown on images on the Site.

1.7 Quantity amount of each product e.g grams, are an estimate only and quantity amount may vary.  

DELIVERY/ SHIPPING INFORMATION

1.8  If you order Products from our site for delivery to one of the International Delivery Destinations, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these charges and we cannot predict their amount.  You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order.

1.9 If Royal Mail STANDARD Europe & International delivery service is selected at check-out, a tracking number is not supplied. Parcels are not insured with this service, which means we are not liable or responsible for these deliveries that may be effected by loss/damage/delays/natural occurrences/transfers to your  local courier in your country and/or extra fees/custom charges and/or back end charges. A full refund is issued for missing/lost in transit items excluding the cost of postage and packaging.We HIGHLY recommend that any European or International customers use our Royal Mail TRACKED service for full peace of mind. 

1.10 You must comply with all applicable laws and regulations of the country for which the Products are destined. We will not be responsible if you break any such law.

RISK AND OWNERSHIP

1.12 Once delivered, the Products will become your responsibility and, except in relation to Products that are:

(a) damaged or faulty when delivered; or

(c) have been incorrectly delivered, we will not be responsible for their loss, damage or destruction after they have been delivered.

1.13 Ownership of the Products will pass to you when:

(a)We have received full payment of all sums due in respect of the Products (including delivery charges); and
(b)the Products have been delivered to you.

PRICE AND PAYMENT

1.14  The prices quoted on the Site include VAT but exclude delivery costs, which will be added to the total amount due once you have selected a delivery service from the available options. Our delivery charges are as advised to you during the check-out process, before you confirm your order. To check relevant delivery charges, please review our 'SHIPPING INFORMATION' page found at the footer of our website.

1.15 Prices might change at any time, but changes will not affect your order if we have already sent you a Dispatch Confirmation.

1.16  By using a credit/debit card to pay for your order, you confirm that the payment card being used is yours. All payment card holders are subject to validation checks and authorisation by the card issuer. If your card issuer refuses to authorise payment we will not accept your order and we will not be responsible to you for any delay or non-delivery of the Products. If your payment card is refused by the card issuer, we are not obliged to inform you of the reason for the refusal. We are not responsible to you if your card issuer or bank charges you as a result of us processing of your payment card in accordance with your order.

1.17  The Site contains a number of Products and it is always possible that some of the Products listed on the Site may be incorrectly priced. We will rectify pricing errors as soon as possible after we become aware of them. If a Product´s correct price is different from the price stated on the Site, we will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your order and notify you.

1.18 The website may offer exclusive promotional discounts and promotional discount codes via Instagram advertisement. We reserve the right to cancel, change/edit these offers as we see fit without notice. 

CANCELLATION, RETURNS AND REFUND POLICY

1.19 If you are a customer, you have the legal right to cancel your contract with us prior to us sending you a Dispatch Confirmation email. 

1.20 To cancel a contract between us, you just need to let us know that you have decided to cancel. Contact us via email at [email protected] or via Instagram DM. We usually dispatch orders between 2 - 3 days  therefore would require a cancel order request from you prior to us dispatching your items. 

1.21 After you cancel your order, any sum collected by us from your payment card will be refunded in full, including the costs of delivery.We will refund any money received from you using the same method originally used by you to pay for your purchase, unless you specifically request otherwise. Refunds for Products purchased as gifts can only be given to a payment card in the name of the person who placed the order.  

1.22 We will process the refund due to you as soon as we can and, in any case, not later than:

(a) 14 days after the day we receive back from you the Products; or

(b) (if earlier) 14 days after the day you provide evidence that you have returned the Products to us; or

(c) if we have not sent the Products to you, 14 days after the day on which we are informed about your decision to cancel the contract with us.

1.23 If any Product you purchase is damaged, faulty or incorrect, when delivered to you we may offer an exchange or refund as appropriate, in accordance with your legal rights. If you believe a Product is faulty, you should notify us by email  in accordance with the returns procedure described in the 'RETURNS' page found on the footer of our website. 

PRODUCT USE DISCLAIMER

1.24 Our glitters/adhesive/foil flake products are not edible.

1.25 Our glitter near the eye area is not recommended. 

1.26 Our glitter near any sensitive areas of skin or face is not recommended. 

1.27 In the unlikely event that a bad reaction occurs,we advise you discontinue use of our product/s and where possible seek medical advice. You assume sole risk and responsibility when using these products.Because each person's skin is unique, we make no warranties, expressed or implied, regarding the effectiveness of our products. You are using products listed on our website at your sole risk and are responsible for all actions and consequences of use and misuse.

1.28 If you have a known allergy to any of the ingredients listed on our website or that are used in our products, we advise against purchase/use.

PRIVACY POLICY 

1.29 Glittertubes.co.uk will not share, sell or trade customer information. Your privacy is important to us. Rest assured that information filled out at checkout is used solely for the purpose of order fulfillment.

INTELLECTUAL PROPERTY RIGHTS

1.30 The Website and all its content is owned by us or our licencors and is protected by intellectual property and marketing legislation. This means that trademarks, company names, product names, images and graphics, design, layout and information on products, services and other content may not be copied or used without our permission. 

INDEMNIFICATION

You agree to indemnify, defend and hold harmless Glittertubes, glittertubes.co.uk ,owner, affiliates, partners, officers, directors, agents, contractors, licencors, service providers, subcontractors, suppliers, interns and employees, from any and all claims, charges, demands, damages, liabilities, losses, expenses, and liabilities of whatever nature and howsoever arising (including but not limited to any legal or other professional fees and the costs of defending or prosecuting any claim and any other direct or consequential loss) incurred or suffered directly or indirectly as a result of using any product listed on our website.
